SUMMARY
A request was filed by Terry Owens of PN Restaurants Inc., for a Special Use Permit to waive yard requirements in accordance with Article 3.N Section C.21. of the Zoning Ordinance of the Code of City of Danville, Virginia 1986, as amended, at 3230 Riverside Drive (Parcel ID #55466), otherwise known as Grid 1713, Block 0013, Parcel ID #000002, of the City of Danville, Zoning District Map.
BACKGROUND
The applicant requests a Special Use Permit to reduce side setbacks for a proposed dumpster enclosure and existing drive-up ATM, reduce the minimum lot width, and reduce the minimum lot size for a proposed land subdivision to develop a fast food restaurant.

The Planning Commission, at their October 13, 2020 meeting, voted 7-0 to recommend approval of Special Use Permit Application PLSUP20200000183 subject to the following conditions:
 
1.      The proposed dumpster must not be closer than 4.1’ to a proposed property line.                     
2. The existing ATM must not be closer than 6.4’ to a proposed property line.
3. The lot width must be no less than 141.6’ feet.
4. The lot area must be no less than 28,446 square feet.
RECOMMENDATION
It is recommended that City Council adopt an Ordinance granting a Special Use Permit to waive yard requirements in accordance with Article 3.N Section C.21. of the Zoning Ordinance of the Code of City of Danville, Virginia 1986, as amended, at 3230 Riverside Drive (Parcel ID #55466), otherwise known as Grid 1713, Block 0013, Parcel ID #000002, of the City of Danville, Zoning District Map subject to the following conditions:
 
1.      The proposed dumpster must not be closer than 4.1’ to a proposed property line.                       
2. The existing ATM must not be closer than 6.4’ to a proposed property line.
3. The lot width must be no less than 141.6’ feet.
4. The lot area must be no less than 28,446 square feet.
