SUMMARY
A request was filed by Mary Davies for a Special Use Permit for Urban Agriculture in accordance with Article 3.E Section C.28 of the Zoning Ordinance of the Code of City of Danville, Virginia 1986, as amended, at 598 Elizabeth Street (Parcel ID #75710), otherwise known as Grid 0619, Block 002, Parcel ID #000014, of the City of Danville, Zoning District Map.  The applicant requests a Special Use Permit to keep chickens.
BACKGROUND
The applicant requests a Special Use Permit to keep chickens. The applicant explained at the October 13, 2020 Planning Commission public hearing, that her father-in-law passed away leaving her 19 chickens.  The City received a neighbor complaint and advised the applicant to apply for a Special Use Permit to keep chickens under the Urban Agriculture zoning provision.  The applicant since reduced the number of poultry to 13 and committed to further reduce the number to five (5) in order to comply with City Code.  The applicant also stated they would place a device on the rooster to eliminate crowing.
The Planning Commission, at their October 13, 2020, meeting, voted 7-0 to recommend approval of Special Use Permit Application PLSUP20200000198 subject to the following condition(s):
 
1.      Any and all accessory buildings meet the zoning setbacks and receive a zoning clearance. 
2. All poultry being raised on the subject property comply with the standards in the definition of urban agriculture in the Zoning Code. The applicant is not allowed more than five (5) poultry at this property. 
3. The applicant must keep the area properly cleaned meaning that carcasses, debris, food waste and excrement are removed once every two (2) days.  This waste must be kept in airtight containers until disposed of in accordance with the City’s ordinances.
4. The applicant shall not maintain a poultry yard or structure within 125’ feet of neighboring residential buildings.
 
 
RECOMMENDATION
It is recommended that City Council adopt an Ordinance granting a Special Use Permit for Urban Agriculture in accordance with Article 3.E Section C.28 of the Zoning Ordinance of the Code of City of Danville, Virginia 1986, as amended, at 598 Elizabeth Street (Parcel ID#75710), otherwise known as Grid 0619, Block 002, Parcel ID#000014, of the City of Danville, Zoning District Map subject to the following condition(s):
