SUMMARY
Special Use Permit Application PLSUP20190000450, filed by Shanks Associates on behalf of Danville Mall, LLC, is requesting a Special Use Permit for a waiver to yard requirements per Article 3.N, Section C, Item 21, of the Zoning Ordinance of the Code of City of Danville, Virginia 1986, as amended at 350 Mall Drive, otherwise known as Grid 1709, Block 001, Parcel 0000021 of the City of Danville, Virginia Zoning District Map.  The applicant is requesting a waiver to the minimum setback requirements to construct a dumpster enclosure.
BACKGROUND
Danville Mall, LLC is requesting to create a new out parcel along Piedmont Drive to the west of the eastern most entrance. This parcel will be served by the ring road surrounding the mall and will be developed with a commercial building. This building will have an external dumpster pad, enclosed by a brick enclosure. The dumpster structure location places it within required yard setbacks.  Based on the proposed new property lines, a Special Use Permit is required.  At their meeting of January 13, 2020, the Planning Commission voted 7-0 to recommend approval subject to the condition that the only yard setback allowed to be zero feet shall be the eastern most setback, and any subsequent new building on the parcel shall comply with setback requirements unless granted separate Special Use Permits.
RECOMMENDATION
