Consideration of Amending Article 3.K and 3.L of the Zoning Ordinance to Address Downtown Housing Uses

A request has been filed to amend Chapter 41 entitled “Zoning Ordinance” of the Code of the City of Danville, Virginia 1986, more specifically, various sections and subsections of Article 3.K entitled “CB-C, Central Business District” and Article 3.L entitled “TW-C, Tobacco Warehouse District”. The purpose of the amendment is to address permitted uses within the CB-C, and TW-C Districts.
Over the past several years, the City has received and approved numerous requests for mixed-use developments in the River District. There have yet to be any known negative impacts from the mixed use developments, even though they each required a Special Use Permit without related conditions. The only conditions for the permits have been to address density and potential impacts from unrequired parking, however, these can be addressed separately. Additionally, the current Ordinance does not permit home occupations within the mixed-use housing.
Danville: 2030 Comprehensive Plan
contains neighborhood revitalization objectives specifically related to housing. The related objectives encourage housing policies which promote homeownership among low- and moderate-income households, new housing in and around the River District, adaptive reuse of existing buildings, and high-quality infill housing (“filling in” empty land within developed areas of the city). Zoning information related to housing is attached for reference. At their August 12, 2019 meeting, the Planning Commission voted 6-0 (Commissioner Bolton was absent) to recommend approval of the request.
It is recommended that City Council adopt an ordinance amending Chapter 41 entitled "Zoning Ordinance", more specifically various sections and subsections of Article 3.K entitled “CB-C, Central Business District” and Article 3.L entitled “TW-C, Tobacco Warehouse District” to address permitted housing in these districts.
