SUMMARY
On July 22, 2021, the Commission of Architectural Review approved Certificates of Appropriateness (COAs) for roof-mounted solar panel installations at 918 Green Street and 154 Chestnut Street within the HP-O, Historic Preservation Overlay District.  Paul Liepe and others appealed the COAs to City Council, as allowed by Chapter 41 Article 3.R.C.11.
BACKGROUND
The applicant, Frederick Meder, requested Certificates of Appropriateness, PLCAR2021-244 and 245 for roof-mounted solar panel installations at 918 Green Street and 154 Chestnut Street, respectively. 

At their meeting of July 22, 2021, the Commission of Architectural Review (CAR) made the following motions regarding COA 2021-244 at 918 Green Street:
 
1.      Mr. Stowe made a motion to approve the Request 2020-244 without the eight panels on this section of the roof.  There was not a second, so the motion failed.
2.  Mr. Weller made a motion that Request 2020-244 does not meet the guidelines. Mr. Stowe seconded the motion. The motion was approved by a 4-0 vote.
3. Mr. Weller made a motion to approve the Request 2020-244 as requested with all panels because the proposal does not have any adverse effect on the neighborhood, that the roof is not a prominent feature of the historic building, that the proposal does not diminish the historic character of the building, and that the appropriateness of roof mounted solar panels are a case-by-case determination.  Ms. Stilwell seconded the motion. The motion was approved by a 4-0 vote.

1.      Ms. Stilwell made a motion that the Request 2021-245 does not meet the guidelines as submitted. Mr. Weller seconded the motion. The motion was approved by a 4-0 vote.
2. Ms. Stilwell made a motion to approve request 2021-245 as requested with all panels because the proposal does not have any adverse effect on the neighborhood, that the roof is not a prominent feature of the historic building, that the proposal does not diminish the historic character of the building, and that the appropriateness of roof mounted solar panels are a case-by-case determination.  Mr. Weller seconded the motion. The motion was approved by a 4-0 vote.
RECOMMENDATION
Article 3.R, Section C, Item 11.D of the City Zoning Code states, "The City Council may affirm, reverse or modify the Review Commission decision and shall notify the Director of Planning/Zoning Administrator of its action."  Staff recommends that City Council review the attached background information and uphold the Commission of Architectural Review’s Certificates of Appropriateness for both cases because the Commission of Architectural Review applied and followed the review criteria as required in Chapter 41, Article 3.R.C.2, A through H.
