SUMMARY
Special Use Permit Application PZ22-00178, filed by Philip W. Winstead has requested a Special Use Permit to operate a childcare facility at 3090 N Main Street (Parcel #59958) in accordance with Article 3.J.C. Item 4 of the Zoning Code.  Operation of a childcare facility at this location will be an ancillary use to the activities related to the church.           
BACKGROUND

3090 North Main Street is currently zoned N-C, Neighborhood Commercial, and is owned and operated by St. Luke's United Methodist Church Trustees as a place of worship.  Philip Winstead, Chairman of the Trustees for St Luke's United Methodist Church, has applied on their behalf for a Special Use Permit to allow 20% of the facility to be used as a childcare facility.  St. Luke's United Methodist Church will rent/lease the facility to a separate entity for operation of the childcare.    
An entrance will be designated for the childcare center and the operation will have access to a kitchen and two (2) outdoor play areas.  Adequate parking is provided onsite.  A site visit by the Building Inspections Division found minor deficiencies that were corrected.    

Twenty-two (22) notices were sent to neighboring property owners within three hundred feet of the subject property.  Three (3) responses were unopposed (Compton, Habitat Village North and Jones).  Zero (0) responses were opposed. 

On October 11, 2022, the Planning Commission voted 6-0 to recommend approval of Special Use Permit Application PZ22-00178.

RECOMMENDATION
It is recommended that City Council adopt an Ordinance granting a Special Use Permit to operate a childcare facility at 3090 N Main Street (Parcel #59958) in accordance with Article 3.J.C. Item 4 of the Zoning Code.
