Consideration of Granting a Special Use Permit to Waive Yard Requirements at 1340 Goodyear Boulevard.

Special Use Permit Application PLSUP 2021-72, filed by Danville Tree Care LLC, on behalf of Philip and Charles Winstead, requests a Special Use Permit for a yard requirement waiver in accordance with Article 3.O Section C.25. of the Danville Zoning Ordinance at 1340 Goodyear Boulevard (Parcel ID# 23011). The applicant requests a Special Use Permit for a yard requirement waiver to replace a non-conforming building that a fire completely destroyed in the LED-I Light Economic Development – Industrial Zoning District.
This applicant would like to rebuild their operations building in the same location where it previously existed, prior to a fire that totally destroyed the legal non-conforming structure. The requested setback is eight (8’) feet and the required setback is 30’.
The Planning Commission, at their April 12, 2021 meeting, voted 7-0 to recommend approval of Special Use Permit Application PLSUP2021-72.
The Planning Commission recommends that City Council adopt an Ordinance granting a Special Use Permit for a yard requirement waiver in accordance with Article 3.O Section C.25. of the Danville Zoning Ordinance at 1340 Goodyear Boulevard, Parcel ID# 23011.
